Tunisia considering handing over ex-Libya premier (AP)

TRIPOLI, Libya ? The visiting Tunisian president is setting conditions for handing over a Libya who was prime minister under ousted ruler Moammar Gadhafi.

Tunisia is holding the ex-prime minister, Baghdadi al-Mahmudi. Beginning his first state visit to Libya on Thursday, Tunisian President Moncef Marzouki said Tunisia would have to be assured that al-Mahmudi would get a fair trial and would not be harmed.

Marzouki told a joint news conference with Libyan leader Mustafa Abdul-Jalil that the ex-premier could be handed over for trial in Libya "after establishing a democratic state and civil institutions."

Gadhafi was captured and killed in October. Libya insists it will try his captured son, Seif al-Islam, though Libya does not yet have a functioning judicial system.
